1. Kerry Local Authorities Traffic Warden Areas

The active traffic warden areas within Kerry Local Authorities can be portrayed diagrammatically as follows
 

A system of parking fees, restrictions and fines is in place throughout towns in Kerry to ensure that careless parking does not cause obstructions for other motorists, businesses and impinge on the safety of pedestrians.

Each of the Kerry Local Authorities employs their own traffic wardens to enforce the parking regulations and issue fines. The local authority is responsible for creating bye-laws that list places in your town/city where parking fees will be imposed. It also decides the value of parking fees.

Parking fees (disc parking, permit parking, car parks and "pay and display" parking) vary throughout Kerry and can be set and adjusted by your local authority.

Traffic wardens are representatives of your local authority and have authority under the Road Traffic Acts (1961 - 1994) to advise motorists of parking regulations and issue tickets for illegal parking and non-payment of parking fees. Traffic wardens also give evidence in court in relation to the non-payment of fines.

2. Legislative Context

Traffic Management can be defined as getting maximum use out of existing street networks without recourse to large scale improvements works. Part 8 of the Road Traffic Act 1968 enabled traffic management functions for a particular area to be concentrated in one local authority.

The Local Authorities (Traffic Wardens) Act 1975 gave local authorities authority to recruit traffic wardens. Traffic Wardens are empowered to issue on-the-spot fines for various offences including parking violations and non-display of current road tax disc.

The Road Traffic (Traffic and Parking) Regulations 1997 provides for the general regulation and control of traffic (including the parking of vehicles) in public places. Local authorities are responsible for authorising regulatory traffic signs and designating areas where parking is restricted or prohibited.

Under the Road Traffic Act, 1994, Road Authorities are empowered to make bye-laws governing the type of paid parking systems they wish to employ and to control the charges and conditions which will apply to such parking.

The Road Traffic (Immobilisation of Vehicles) regulations 1998 provide for the immobilisation of vehicles which are found to be parked on a public road in contravention of a prohibition or restriction imposed by Section 35 or 36 of the Road Traffic Act, 1994.

The Road Traffic Act, 2004 provides for the Fixed Charge Penalty Notice. With effect from Monday 3rd April 2006, the Fixed Charge Penalty Notice was introduced nationally by the Department of Transport, as part of the Government’s extension of the Penalty Points System. The Fixed Charge Penalty System has been introduced for Traffic and Parking Offences. The Fixed Charge Penalty System prescribes that when the notice has been issued, the fixed charge must be paid within 28 days. If the charge has not been paid, the charge is increased by 50% and the increased charge must be paid within a further 28 days. No payment is acceptable after 56 days. The regulations provide that if the charge has not been paid within the 56 days, the offence is then the subject of a summons.
